People taking of the Unified Patent Court remind me of Sir Gawain and the Green Knight, (namely Bertilak de Hautdesert). When Gawain be-headed the Green Knight, the head of Bertilak could still speak and said: "we will see us in the future". So talking of the UPC sounds like: "we will see in the future". These are talks of people who have lost their head.

The registration and protection of trademarks and distinctive signs is extremely important, as they are intangible assets, which help create value by differentiating the quality and the particular characteristics of the different products and services that are offered on the market, solving in great proportion the existing information asymmetries at the time the consumer purchases such products or services.

Intellectual property, in any form is the basis for a knowledge economy. To capitalize on intellectual property, it is necessary to have a vibrant innovation ecosystem starting with government policies to advance innovations, universities, industry, entrepreneurship, the presence of capital and the ability of these and others to cooperate to take advantage of intellectual property.

The industrial economy is preoccupied with tangible capital (objects); but what powers the knowledge economy is intellectual capital (ideas). While tangible goods generally enjoy secure property rights, intangibles are more difficult to protect. Our ability to reward creative activity and investment in intellectual capital is critical to the future of a prosperous global economy. Intellectual property will play an increasingly important role as the industrial world fades away, and new business models come to the fore. Where intellectual property protection is available and honored, creative activity employment growth, and prosperity can be sustained for the benefit of society and humanity.

I have a few things to say about the brand: 1. If it's worth promoting, it's worth protecting! 2. Why build a brand if you don't protect it? 3. Don't ever let anyone convince you that protecting your brand is not important. 4. If it's remarkable, it's trademarkable! 5. Build your brand and turn your business from faceless to legendary!

In the current scenario of Intellectual Property protection system, "Break through innovations" and "Disruptive inventions", which require patience and meditatory voluntary original ideation, are rare and extinctive, while incremental & even frivolous inventions are increasingly surfacing, leading to grant of more evergreening patents, due to over emphasis on early ROI through prior commitments of commercialization and market pressures. Consequently, even serendipitous inventions are also not forthcoming, anymore.

Cleaning / curing / standardizing assignee names is one of the most time consuming and efforts intensive steps in patent analysis. It is required for best possible understanding in landscaping. After merger and acquisitions, assignee names may or may not be changed. Quite a few databases and/or analytical tools provide capabilities of cleaning assignee, some automated and some manually. Still it is a difficult task with missing assignee names, JVs, M&A, divestment, etc.

A knowledge economy relies on IP-driven growth, the core component of which is creativity. IP laws and an enforceable legal environment can only encourage IP protection activities, but not creativity. It requires an overhaul of education system, right from the kindergarten level, It also requires overall focus on increasing scientific temper and encouraging critical and divergent thinking.

You know about patents or not, you file patents or not, you are David or Goliath, you are a novice or an expert, you are in X vertical or Y, either now or in future, voluntarily or obligatorily, to earn profit or to prevent a loss; your prospects in the innovation economy, are inevitably linked with patents. It is prudent to be proactive BECAUSE you may not even get a chance to react.
