    Innovation economy is going through profound transformations driven by two main factors: 1. The expansion and diffusion of education and research around the world and consequently the widespread increase in inventions and patent filling; 2. The use of complex technologies to solve more complex problems or to meet more specific needs; thus innovations are now quite always the result of combinations of inventions found in different fields stemming from different sources. The combination of these two factors shows that the diffusion and the trading of inventions and thus IP rights is an unavoidable necessity. Patents have consequently to change their nature, becoming more a technology transfer instrument and a valuation/ transaction asset than a means of protection and legal redress. The logical consequence that our economies should draw from these transformations is to establish systems and mechanisms to allow companies and small and medium-sized enterprises (SMEs) to acquire the inventions and IP rights they need, and to give inventors the opportunity to disseminate and be rewarded for their inventions. Thus, a real patent exchange market is now critical for the success of innovation economies.

    Recent developments like surge of new disruptive technology realm (Technology 4.0) and release of new evidence by WIPO suggesting IP and other intangible capital contribute around one third to the value of industrial production are potentially capable of influencing the way global impact of IPR may be progressively relooked in future. 
    On the other hand, the conservative sui generis plant variety protection (PVP) and non-patentable subject matter options embraced and implemented in few jurisdictions like India continue to hinder trade-related growth in agri-bio-technology and plant variety business as also hamper domestic seed R&D industry, including foreign collaborators and MNCs operating in these territories. 
    There is adequate and trustworthy space now provided as per National IPR Policy 2016, by IPIndia for intermittent interface among regulators, executive functionaries and IP stakeholders that helps resolve procedural difficulties and refine processes on course. However, PVP is kept out of such arrangement. In PVP and agro-biotech patents realm, conflict of actions at multiple check points continues to cause ambiguity, uncertainty or neglect. Thereby many jurisprudential issues have arisen.    
    The implementation of India’s Protection of Plant Varieties and Farmers’ Rights Act, 2001 is functionally nested in two dissimilar domains, one dealing with IPR aspect of PVP grant as per TRIPS Agreement and the other one with equitable rights of communities and farmers as per CBD and ITPGRFA. In practice, there is due emphasis on scaling up farmers’ welfare efforts via farmers’ rights in the system. However, the spirit of IPR law with regard to varieties and biotechnologies continues to be paralysed. So much so that even the domestic legal acumen appears to be bankrupt of ideas considering a recent advocacy made in favour of curbing provisional protection to applicants of PVP. Similarly, under Patent law, a favourable re-interpretation of statues is warranted to clarify on acceptance of in planta validation of a gene as claimable in a patent application. This could be possible in corollary to the interpretation already made in patenting of embedded software. 
    It is important to foster IPR culture dealing with plant varieties and agro-biotech in big market jurisdictions like India. Bringing PVP implementation under common umbrella of IPIndia is much needed. Similar actions were already taken for Copyright and Layout Designs for ICs. However, for any requisite technical input, Ministry of Agriculture and Farmers’ Welfare continue to be the nodal ministry as per the stated IPR Policy.
